Those are also often good cracks to shove a good faith and fair dealing violation into (or a prevention doctrine defense). If the firm wasn't providing enough work, it can't claim breach. But I don't know enough about the facts or the agreement.

Burckhard received a base salary of $60,200 per year in

exchange for agreeing to bill at least 27 hours per week. See [Doc ID# 9,

10.]

[¶ 8] Burckhard did not dispute the damages calculation in either

his Declaration or MSJ Response. See [Doc ID# 22, 23.] In fact, he

admitted he was credited with 1,423.22 hours. See [Doc ID# 22], “second”

¶ 4. He did not specifically deny being credited with 108.33 holiday

hours, but merely denied any overpayment had been made. Compare

Compl., [Doc ID# 1], ¶ 9, with Answer [Doc ID# 17], ¶ 7; see also [Doc ID#

10], (under column titled “Holidays”). These figures resulted in a total of

1,531.55 hours credited to him during his employment. He also admitted

that he was paid for 2,229.43 hours at the rate of $42.75 per hour.

Compare [Doc ID# 1], ¶ 8, with [Doc ID# 17], ¶ 7. Thus, there was no

dispute that he was paid $96,316.54, but his actual earned salary based

on his billable hours was $65,431.16, resulting in a $29,885.38 shortfall

(i.e., he was 697.88 hours short of his required billable hours for the

amount he was paid).
