I don't think cops have ever been required to "know the law." It's a case-specific analysis as to whether they had reasonable suspicion to detain the suspect. A cop can have reasonable suspicion without knowing reasonable suspicion is necessary. For that matter questions like "do you know what's required to certain a suspect?" is an idiotic question since there are an infinite number of things that could theoretically "required." Maybe the cop is required to be on duty. Maybe the cop is required to ensure they have all the necessary tools on hand and don't need backup before attempting arrest.

The city can't rely on these same cops to be incompetent in ways that advance some corrupt purpose, because their incompetence will manifest in random, unpredictable ways.

I've had a couple DUIs tossed because the defendant confessed while surrounded by cops questioning them in an argumentative fashion, even though the defendants weren't formally under arrest. In one case, five massive cops cornered a 90 lb girl in a parking garage and got her to confess to throwing a flip flop at her boyfriend, which resulted in them arresting her for domestic violence battery. That got dismissed after the suppression hearing.

There's a whole line of cases that specifically address this issue. Traffic stops can't last longer than reasonably necessary to accomplish the purpose of the stop. A cop can't just stop you for speeding and then hold you there for an hour because he smells weed & wants a K-9 to come out because you refuse to let him search your car.

If the cop had said "actually I think they're both kinda same thing insofar as they both constitute deprivations of liberty" you couldn't impeach him with that.

Those distinctions seem irrelevant in this context. And as a threshold matter both are deprivations of liberty under the 5A. You're not without due process rights when you're being detained for questioning. The depo questions are about shit like asking for ID. You know cops are always asking people for ID even when people are under no obligation to have ID on them or produce it. lol@ trying to make a stink about cops arresting a guy they had cause to bring in for questioning too. If that's what this case turned on they shouldn't have even settled for $10k.
