"Carlson’s lawyers told Axios that any legal action by Fox would violate his First Amendment rights."
Tucker, you need some better lawyers, bro.

That appears to be an uneducated reporter's legalistic rephrasing of what was purely a rhetorical PR argument. The lawyers didn't say that, and it obviously isn't his legal position.
-----------------------------
Carlson’s lawyers told Axios that any legal action by Fox would violate his First Amendment rights.
“Fox defends its very existence on freedom of speech grounds. Now they want to take Tucker Carlson’s right to speak freely away from him because he took to social media to share his thoughts on current events," said Carlson's lawyer, Bryan Freedman, in a statement to Axios

lol, why the fuck would fox news be willing to pay tucker through 2025 to do absolutely nothing instead of releasing him from his contract and paying him nothing
the only rational explanation for this is some kind of elaborate conspiracy theory involving fox execs being willing to light millions of dollars on fire in order to marginalize their perceived political opposition, which is a pretty "odd case" considering that they were previously paying this guy to do political commentary on their own network
an "odd case" indeed, goy

He's independently uploading a clip to social media of him speaking about various topics and presumably there is no contract with Twitter or anybody else to do this.
It would be extremely hard to draft an enforceable provision to bar this.

there's no "competition" happening here dude, lol. that's why this is all so silly and noteworthy
some normie watching a tucker clip on twitter on his lunch break does not prevent him from watching hannity on fox at 8pm or whenever. they are objectively not in competition with each other, at all
god damn everything really is an IQ test

You posting affect is no different than a typical reddit loser with a baseless air of being a "serious" person who has seen it all. All of this faggotry in a single thread.
> "God damn, you people are morons. There's no need for an elaborate conspiracy"
> "Are you confused every time someone wants to enforce a contract?"
> "This is another aspect of xo "analysis" of events that is so maddening. In the real world, people don't wait to act until they have a surefire zero risk plan"
> "That's not a real world perspective."

I'm not a lawyer. What exactly are Tucker's options, either for breaking the contract or continuing in spite of it?
Can he simply say that because he isn't being compensated (edit: for his online videos, by a competitor to Fox), and is simply broadcasting through his personal account on social media, he's not in competition?

MFCR
Absolutely amazing that their are libs in here who truly believe that American courts are going to send Tucker Carlson to jail in 2023/2024 because he won't stop tweeting about the Ukraine war. America is dead, but the corpse isn't THAT cold yet.
Really makes you wonder what else these ((("people"))) are completely wrong and insane and delusional about...

Assuming the contract is reasonably drafted and he's covered by the primary term (not the covenant not to compete afterwards) he has zero options that do not expose him to catastrophic litigation.
The language in the contract is likely broad enough to cover whatever they want it to (during the primary term). He has probably consented to a jurisdiction where this is specifically enforceable.
He can take a risk and make a political decision that Fox will not take legal action because of appearances (what his Twitter show was probably banking on) but that is not a legal consideration.
Legally he is fucked.
After the primary term if there is an extended CNC after compensation ends enforceability is much dicier. I do not have multi-state experience with CNCs but would assume this period cannot extend more than 2-3 years in any case.
bottom line: His twitter show absolutely can be competition even if unpaid. And, during his primary term (while Fox pays him) he's hooked.

To be fair,
There appears to be a contingent on XO that sincerely believes that no matter what, courts will strictly interpret and enforce EXTREMELY broad and long non-compete agreements -- right up to and perhaps including throwing someone in jail for not complying with a court order issued to enforce them which forbids a person from publicly sharing their own personal opinions on important political issues of the day (if that's what the noncompete ostensibly says they can't do) in the lead up to a presidential election year -- because noncompetes are ironclad legal chains that trump all other considerations in the world, and if it says X in the contract, then judges have absolutely no ability to ever refuse to enforce X or limit the enforcement or X or curtail the reach of X or judicially modify what X says or...
Then there are people on XO who think that in the real world, courts regularly strike down, or, if they do enforce them, judicially modify noncompete clauses that they find to be unduly broad or burdensome or long in duration when weighed against a whole host of other considerations (public interest, etc.), and that realistically in any event the *actual* practical recourse for a company that seeks to enforce a noncompete against an employee who is being given a bunch of money to sit at home and refrain from sharing his own personal political opinions online is the mere forfeiture of that money (and possibly repayment of any of it that has already been paid out), rather than sending the guy to jail for "contempt" if he continues to share his personal views on political issues online in the year leading up to a presidential election.
IMO it's very hard to figure out which group is correct and has a good grasp of the world, and which group is totally fucking retarded and has not idea what it's talking about. We'll just have to wait and see!

"Uh, sorry hoss, but you expressly contracted NOT to have sex for a full year. It's literally right there in the contract, plain as day. And yet here you are, trying to get laid on this dating app. We have you dead to rights, you're fucked now bro.
A contract is a contract. If it's written on the page, it's enforceable in a court of law -- trust me, I went to law school, I know these things. I mean, shit -- you think judges just ignore contractual language when they want to, or throw out expressly-contracted-for provisions if they don't like them, or change the terms of the contract on the back end? You have a lot to learn about this world of law, bud!"

shadow is 100% correct. this is a really straightforward non-compete issue.

To be fair,
So you're saying that I can legally contract with my private employer and agree that, in exchange for money, I will refrain from engaging in *any public political speech* (i.e., exactly the type of speech that sits at the very core of the 1st Amendment and is subject to the strongest possible legal protections from all forms of federal, state, or local government content-based censorship or punishment under the 1st Amendment of the US Constitution which by its very nature trumps all other non-constitutional statutes, laws, codes, etc.) for a lengthy period of time...
...and then, if and when I violate that provision of my private contract by publicly sharing my thoughts on political issues, not only will an American court actually issue an ordering legally requiring me to shut the fuck up and refrain from publicly commenting on any political issues for the duration of the term (instead of just saying "OK you violated the contract so you have to pay the money back")...
...but I will literally be sent to *jail* by that very same court if I refuse to comply with the court order and instead continue to publicly share my personal views on political issues?
(And of course if this did happen, it would all be upheld on appeal by yet another court while I rot in jail for publicly speaking my mind about political issues, because that's just how this shit works?)
And not only that, but (what are the odds!) you yourself have *personally* drafted numerous provisions to that effect and then watched how they play out, and so you -- aka the sane and intelligent guy who unironically thinks we need NATO boots on the ground in Moscow yesterday -- are an "expert" on this topic who knows how this *actually* plays out IRL?
Wow, I'm convinced, you got me. Truly, private contracts are very powerful things! "One | Weird | Trick" to legally strip an American citizen of their right to engage in any form of public dialogue concerning core political issues for years on end, under penalty of state imprisonment enforced by armed guards! Thank god I poast on a "law school discussion bort" where I learn this type of stuff from real lawyers haha yeah.
