until Jan 3, 2027 when the new Congress is sworn in, Donald Trump has the legal authority as POTUS (Commander-in-Chief) to wage war against Iran (without Congressional approval) as he sees fit: under Article II, Section 2 of the Constitution-- elections indeed (2024) have consequences
under the War Powers Resolution:
Trump is only required “in the absence of a declaration of war” to report to Congress within 48 hours AFTER introducing United States military forces into hostilities, which must end within 60 days unless Congress permits otherwise. |
