apparently the MEE had a couple rule against perpetuities questions, and all the test prep companies said don't bother learning it because it's never tested. they're all absolutely fuming and pledging to take down the NCBE once *they're* in charge. |

law school and the bar is 90% memorizing ancient laws that don't exist anymore and applying them. |

i don't know that you can make it much harder without making it unfair.
the shitty lawyer problem is really about apprenticeship, mentoring and the deluge of shit law schools. i don't think the bar fixes that. |

ljl at spending thousands on barbri or watching their flame lectures (i tried a couple times and wanted to kill myself). if you can't just read an outline of the shit that you already learned as a 1l and pass the bar idk what to tell ya. the most helpful thing is taking a bunch of practice questions so you know where you're weak or what you have a misunderstanding about. |

Date: July 28th, 2022 1:39 PM Author: Contagious ivory ticket booth exactly. i remember how many questions were specifically designed to trick you. one i remember in particular was a question about anti-commandeering doctrine and one answer being "the 10th amendment" and another being "because of the anti-commandeering doctrine based on the 9th amendment". the doctrine is based on the 10th amendment, so that's the correct answer. but most people are going to get it wrong because they see "anti-commandeering" and select it.
it's complete bullshit. i hate that so many standardized tests are designed this way. you have to learn the test, not the content. |

this was a long while back like over 10 years, but once you figure out they're all this way. you recognize that content, while important, is only some of the game. the real push is learning the techniques.
i know a guy who im sure has sat 3 times and has failed and currently ubers. i remember his posts were "but i know all the law, i don't understand how i keep failing." i reached out to explain this to him, but, i dunno man. some people really suck at taking tests. |

I remember reading something similar about standardized test design when I was studying for the LSAT. The way they make manageable and statistically predictable questions that will work regardless of the applicant pool (e.g Feb takers performing worse than July takers) is via the experimental questioning to figure out which questions will have a high failure rate among high scoring testers. And the way they often achieve this is via tricky bullshit that will trick someone that knows the content into selecting the wrong answer on some bullshit. So it's essential that you learn the test in addition to the content. |
