stupidest shit ever. couldn’t appreciate that killing her children was wrong” may be an excuse from a retributive perspective, but from a public safety perspective it's an aggravating fact.

Iirc from my CRIMLAW voluntary vs involuntary intoxication is determinative in most jurisdictions but it's a sentencing punishment issue or something like that. Even if voluntary and you're too high to know what you're doing there is no men's rea
Yeah. They can have it as a deciding factor for how calculating someone was and how evil based on whether they "appreciated that it was wrong" or whatever, for pure narrative purposes, but in terms of guilt and sentencing it should be aggravating. Someone that goes into states where they can't help but kill or appreciate it is wrong needs to be locked up for longer with less chance for parole.

Well the good thing about NGRI, or at least in another historical American society the good thing, is that there's no maximum sentencing. You could just park an anti-social psycho in the looney bin and keep them there forever, officially until they were cured and not crazy anymore, which was never.

Agreed 100%. Some maniac walking off the subway and stabbing some chick who contrary to XO opinion went to school, was probably top of class, worked hard, fell in love with someone, and parents loved her all gone in an instant shouldn’t have her killer walk free because it’s “insane.”

my impression is that NGI seemed to be something that was trendy during the heyday of 70s shitliberalism, when multiple high-profile NGI verdicts were won, but which became almost unknown during the 80s/90s/00s law & order backlash era once people realized it was bullshit.
i remember dozens of high-profile cases in the 90s in which the defendant tried for NGI but ended up in the electric chair.
like a lot of discredited 70s shitlib excesses, it seems to have been inexplicably resurrected in the last decade.
